Withdrawing from your subscription
This is a translation provided for your convenience. The French version is the reference text and prevails in the event of any discrepancy. This does not affect the mandatory consumer protections available to you under the law of your country of residence.
You have just taken out a Kotsu subscription and you have changed your mind. That is your right, you do not have to give any reason, and this page explains how to go about it.
1. The simplest way
The "Withdraw from the contract" button is in your subscription settings.
It is free, it takes a few seconds, and you immediately receive a dated acknowledgement of receipt. It is also the route that leaves the least room for doubt, since the date of your request is recorded automatically.
You can also write to us at contact@kotsu.shop or send us the form reproduced in section 5. Any statement that unambiguously expresses your decision to withdraw is valid.
2. The time limit
Fourteen days from the day you took out your subscription.
If the last day falls on a Saturday, a Sunday or a public holiday, the time limit is extended to the next working day. Sending your request on the fourteenth day is enough: what counts is the date you send it, not the date we read it.
3. What happens next
We acknowledge receipt of your request without delay, on a durable medium.
Your subscription ends immediately and your account moves to the free tier. Your setup is kept: your page, your listings, your templates, your commissions and your reviews all stay in place. The features reserved for paid plans simply stop being available.
The refund is made no later than fourteen days after we receive your request, using the same means of payment you used when you subscribed, at no cost to you.
The amount refunded
When you subscribed, you asked us to start providing the service immediately, without waiting for the end of the fourteen-day period. That is what allowed you to use Kotsu straight away.
In that case, the law provides that you remain liable for the part of the service actually supplied up to the day of your request. We refund you the rest.
Example. You take out the Studio plan at 29 € on 1 April, a month of thirty days, and you withdraw on the 6th. Five days have been used out of the thirty in that month, which comes to around 4,83 €. We refund you around 24,17 €.
The calculation is always made in the same way: the price of the period you subscribed to, divided by the actual number of days it contains, multiplied by the days elapsed. A month of thirty-one days, or an annual subscription, therefore gives a different amount.
If you are still in the free trial period, you have paid nothing, so there is nothing to refund. Withdrawing simply puts an end to the subscription before it starts.
4. Cases where this right does not apply
If you are a trader subscribing for your business, the right of withdrawal under the French Consumer Code (Code de la consommation) is not available to you. You can, however, cancel at any time, in a few clicks, under the conditions set out in article 8 of our Terms of Sale.
This right does not cover costume commissions. It concerns your Kotsu subscription, and that alone. The commissions you place with a maker fall under the contract you enter into with that maker, and under the maker's own terms. Kotsu is not a party to it.
5. Model withdrawal form
Complete and return this form only if you wish to withdraw from the contract.
The French version of this form is the authoritative one and it can be used as it stands: the translation below is provided to help you understand it.
For the attention of: Anis Rahimi, sole trader (entrepreneur individuel) 173 rue de Courcelles, 75017 Paris, France contact@kotsu.shop I hereby give you notice of my withdrawal from the contract for the provision of the following service: Service concerned: Kotsu subscription, plan ................................... Ordered on: ................................... Name of the consumer: ................................... Address of the consumer: ................................... Email address of the account: ................................... Signature of the consumer (only where this form is notified on paper): Date: ...................................
This form reproduces the model set out in the annex to article R221-1 of the French Consumer Code (Code de la consommation). Its use is not mandatory.
6. Not to be confused with cancellation
These are two different things, and it is better to know which one you want.
| Withdraw from the contract | Cancel | |
|---|---|---|
| When | Within 14 days of subscribing | At any time |
| Who for | Consumers and non-professionals | Everyone |
| Effect | Immediate | At the end of the period already paid for |
| Refund | Yes, pro rata | No, the current period remains due |
| Where | "Withdraw from the contract" button | "Cancel your subscription" button |
Both buttons are in the same place, in your subscription settings.
